Penalty Fee Agreement for Early Cancellation of Membership
This Penalty Fee Agreement (the "Agreement") is made and entered into as of sign up date, by and between the customer (the "Customer") and MOVEMENT & SPORTS MEDICINE CENTRE (the "Fitness Centre").
Whereas, the Customer has entered into a membership agreement with the Fitness Centre for a term of less than six months (the "Membership Agreement");
Whereas, the Membership Agreement includes a provision that requires the Customer to pay a penalty fee if the Customer cancels the Membership Agreement before the end of the term of the Membership Agreement;
Whereas, the parties desire to set forth the terms and conditions of the penalty fee;
Now, therefore, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:
Penalty Fee. If the Customer cancels the Membership Agreement before the end of the term of the Membership Agreement, the Customer shall pay a penalty fee of $299 (the "Penalty Fee"). The Penalty Fee is a reasonable estimate of the damages that the Fitness Centre would incur as a result of the early cancellation of the Membership Agreement.
Payment of Penalty Fee. The Customer shall pay the Penalty Fee within 30 days of the cancellation of the Membership Agreement. The Penalty Fee shall be paid in full, and shall be made payable to the Fitness Centre.
Release of Claims. The Customer hereby releases and discharges the Fitness Centre and its agents, employees, officers, directors, successors and assigns from any and all claims, damages, liabilities, costs, expenses, or demands arising from or related to the penalty fee.
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the state of Singapore.
Counterparts. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
Refunds. No refunds or whatsoever will be provided for unused sessions/ classes in the associated membership once deducted for the month.
Class Late Arrivals Clients who are attending a class will not be allowed entry of session once it starts. This is to respect everyone's time. No refunds, carry over, make up, or rescheduling is permitted. Refund, rescheduling, or bookings are to be done at least 24hours in advanced or the session will be considered forfeited.
Photography & Videography We may take photographs and make videos &/or sound recordings in & around our premises from time to time. You may be captured in such photographs & recordings. We may use such photographs &/or recordings in our publications, websites & other communication channels, as well as in third party media, or display them in & around our premises and/or the premises of the MSMC. CCTV may be in operation in & around our premises as necessary in the interests of security.
Refund Refunds for refused entry to class due to late arrival(s) will not be permitted under any circumstances as the session is being facilitated. For a full refund, at least 7 days before the session/ event is scheduled to start or within 24 hours of purchase. In the event that the session / event is booked within the same date/ day, refunds are not permitted under any circumstances.
Teacher's Obligation Should you be the only one booked in for the class, the teachers will have a 10 mins window of courtesy wait time before deciding to close the session.
Third Party App & Links If you are booking via a 3rd party app(not through our website), you understand that you may be put on waitlist or have your class cancelled to make way for our direct bookings.
Lost & Found Other than personal electronic devices, personal belongings such as water bottles, tops, pants/shorts, etc that have not been claimed within 24hrs of the session will be discarded.
TERMS OF AGREEMENT | Personal Training & Functional Stretch Therapy (F.S.T) packages By purchasing a personal training package or F.S.T, the purchaser ("Client") is entering into a binding agreement with Movement & Sports Medicine Centre ("Trainer") under the following terms: 1. VALIDITY OF PACKAGE The personal training package is valid for a term of ten (10) weeks- based on 10 sessions block from the date of the first scheduled session. The expiration date is immutable, and sessions not utilised within this ten-week period shall be automatically forfeited without exception.
2. NO REFUND OR EXTENSION POLICY Once purchased, the package is non-refundable and non-transferable. There shall be no rollovers or extensions of any kind for any sessions remaining post the expiry of the ten-week period.
3. CANCELLATION AND LATENESS (a) Cancellations must be made with a minimum of twenty-four (48) hours notice. Failure to do so will result in the session being forfeited. (b) The Trainer is under no obligation to extend a training session if the Client arrives late. The session shall end as per the pre-determined time with no adjustment to the package fee.
4. ACCEPTANCE OF TERMS The purchase of a personal training package constitutes the Client's full acceptance of these terms, which form a legally binding agreement. By completing the purchase, the Client confirms they have read, understood, & agreed to these terms.
AGREEMENT INTEGRITY These terms represent the full agreement between the Trainer and the Client regarding personal training packages. They supersede all prior discussions, agreements, or representations. It is the Client's responsibility to ensure that they have read and understood the terms outlined before committing to the purchase of a personal training package. The terms are legally binding, & by proceeding with the purchase, the Client agrees to & accepts these conditions in full.
Cancellation Policy for Movement & Sports Medicine Centre At Movement & Sports Medicine Centre, we are deeply committed to providing exceptional service and ensuring a seamless experience for all our valued clients. Our comprehensive cancellation policy is designed to maintain fairness & efficient scheduling, particularly for our highly sought-after Cold Exposure sessions, Premium classes, and regular fitness classes.
General Policy: To facilitate optimal scheduling & service delivery, we require all clients to provide a minimum of 24 hours notice for any class cancellation. This advance notice allows us the opportunity to reallocate the slot to another client, ensuring our schedule operates as efficiently as possible.
Cold Exposure & Premium Classes: The high demand & limited availability of our Cold Exposure sessions and Premium classes necessitate a stringent cancellation policy. For cancellations made less than 24 hours before the scheduled session time, a fee equivalent to the full drop-in rate of $190 for Cold Exposure sessions, or the full price for associated Premium classes, will be incurred.
Fitness Classes: For our regular fitness classes, a no-show or late cancellation fee of $21 will be charged for cancellations made less than 24 hours before the scheduled session.
Medical Cancellations: We understand that unexpected medical emergencies can arise, leading to last-minute cancellations. In such cases, we are prepared to waive the cancellation fee, provided that a valid medical certificate from a recognised medical physician is presented. It is important to note that healthcare providers from alternative or allied health fields, including allopathy, chiropractic, osteopathy, and Traditional Chinese Medicine (TCM), are not authorised to issue a medical certificate for the waiver of cancellation fees.
Member Cancellations: As per our existing policy, members can cancel bookings without incurring a fee if the cancellation is due to a medical emergency. This requires a valid medical certificate from a recognised medical physician to be provided as evidence of the emergency.
Immediate Family Members: The provision to cancel bookings due to medical emergencies is now extended to include immediate family members of the member. For the purposes of this policy, "immediate family members" are defined as the member's spouse, children, parents, grandparents, and siblings.
Evidence Requirement: To cancel a booking under this provision, the member must provide a copy of the medical certificate indicating the family member's condition that necessitates the cancellation. The certificate must be issued by a recognised medical physician.
Policy Rationale: This policy is essential not only to ensure we can continue to offer the highest quality of service to all our clients but also to sustain the costs of business operations. The cancellation policy helps us manage our resources effectively & maintain the viability of our business, ensuring that we can continue to provide top-notch services/ or classes & support to our community.
